Limited Warranty – USA
Ant5, Ant6, and BRAT electric bicycles
Effective Date: Coverage under this Limited Warranty begins on the date the Bike is delivered to you.
Each new electric bicycle (the "Bike") sold by Coast & Pedal ("Coast & Pedal," "we," "us," or "our") comes with the limited warranty set forth herein (the "Limited Warranty") for the retail purchaser ("you" or "Customer"). This Limited Warranty applies to the following models:
- Ant5 and Ant6, manufactured by Marsant's X (each an "Ant Bike"); and
- BRAT, manufactured by Volcon, Inc. (the "BRAT").
Where a term below applies to only one model, it is identified by model name. A PURCHASE RECEIPT from Coast & Pedal is required for valid warranty coverage on every Bike.
1. Limited Warranty
1.1 Ant Bikes. We warrant that, for a period of TWO (2) YEARS from the date the Ant Bike is delivered to you, the Frame, Battery, and Original Components (each defined below) will be free from manufacturing defects in material or workmanship.
1.2 BRAT. We warrant that, for a period of ONE (1) YEAR from the date the BRAT is delivered to you, all BRAT Covered Components (defined below) will be free from defects in material or workmanship. We further warrant that the BRAT battery will maintain sixty percent (60%) or higher capacity for at least five hundred (500) charge cycles or TWO (2) YEARS from the date of delivery, whichever comes first.
1.3 Definitions.
- "Frame" means the main structural frame of an Ant Bike.
- "Battery" means the original removable battery pack supplied with the Bike.
- "Original Components" means the original parts and components installed on an Ant Bike at the time of sale, excluding Wear Items (Section 7) and free accessories.
- "BRAT Covered Components" means the BRAT's hardware, frame, forks, motor, controller, display, and electrical sub-assemblies.
- "Warranty Period" means the applicable coverage period stated in Sections 1.1 and 1.2.
1.4 Intended Use. Each Bike is intended for personal use only and must not be used for commercial purposes or in connection with a rental operation or program.
1.5 Sole Warranty. To the fullest extent permitted by law, this Limited Warranty is the sole warranty made by Coast & Pedal. No oral or written information, statement, or advice provided by Coast & Pedal, its suppliers, agents, or employees will create a warranty or increase the scope or duration of this Limited Warranty.
1.6 E-Bike Classification and Local Laws. Each Bike is sold as a Class 2 electric bicycle, with motor assistance limited to twenty (20) miles per hour. E-bike laws vary by state and locality and change over time. You are responsible for verifying, and periodically reverifying, that your use of the Bike complies with all state and local laws governing e-bike operation, including age, helmet, and riding-area requirements.
2. Who May Use This Limited Warranty
2.1 Ant Bikes. The Limited Warranty covers the original purchaser and registers automatically upon purchase from Coast & Pedal. If the Ant Bike is sold or otherwise transferred, the subsequent owner may receive the remaining Warranty Period only if (a) the Warranty Period has not expired, and (b) the subsequent owner provides the original purchaser's name and original order number.
2.2 BRAT. The Limited Warranty covers the registered owner. If the BRAT is sold or otherwise transferred before the Warranty Period expires, coverage continues for the remaining Warranty Period only if the subsequent owner completes a new warranty registration at bratebike.com/pages/warranty-registration.
2.3 No Extension. The Warranty Period is not extended or restarted by any repair, replacement, or transfer.
3. Requirements for Limited Warranty to Apply
Failure to comply with any of the following requirements will void the Limited Warranty.
3.1 All Bikes.
- You must provide the original Coast & Pedal purchase receipt or order number as proof of purchase.
- The Bike must have been used in accordance with its intended purpose (see Section 6).
- No part of the Bike, including electronics, connectors, and cables, may have been repaired, replaced, or modified except as authorized under this Limited Warranty.
- The Bike's serial number or barcode must not have been removed, defaced, damaged, altered, or made illegible.
- The Bike must have been used only for personal use, and not for commercial purposes or in connection with a rental operation or program.
3.2 BRAT Only.
- You must register the BRAT within thirty (30) days after delivery at bratebike.com/pages/warranty-registration. All fields are required.
- The BRAT must have been purchased and used only in the United States.
4. How to Make a Warranty Claim
4.1 Notice. To assert a warranty claim, you must notify Coast & Pedal by email at service@coastandpedal.com during the applicable Warranty Period. Your notice must include your order number, the Bike's serial number, and photographs or video of the defect.
4.2 Evaluation. Coast & Pedal will respond within twenty-four (24) hours and will initially work with you to identify any possible simple fix. You must provide photographs and information as reasonably requested to evaluate your claim. No part will be replaced before the defect has been documented by photograph or video.
4.3 Determination. For Ant Bikes, Coast & Pedal or Marsant's X will determine whether a component is defective and covered. For the BRAT, Coast & Pedal will coordinate the claim with Volcon, Inc., and Volcon or one of its certified service centers or dealerships may contact you directly to evaluate the claim.
4.4 Shipping Damage. Damage occurring during delivery is not a warranty claim. If a Bike arrives damaged, you must notify Coast & Pedal with photographs or video within seven (7) days of delivery. Claims made after seven (7) days will not be accepted. Scratches to free accessories during shipping are not eligible for replacement or compensation.
5. Remedies Under This Limited Warranty
5.1 Ant Bikes. If a defective Frame, Battery, or Original Component is determined to be covered, it will be repaired or replaced at no charge for the part, subject to the following:
- Frame. Coverage includes a replacement frame only. Labor to transfer components to the replacement frame is not included. A replacement frame may be drawn from scratch-and-dent stock, and a frame style or color not in stock may be replaced with a compatible style or color.
- Battery. A defective Battery will be repaired or replaced at no cost. A repaired or replaced Battery retains the original Warranty Period. No cash reimbursement will be made.
- Original Components. Replacement parts are provided at no charge. If more than fifteen (15) days have passed since delivery, you are responsible for shipping costs on replacement parts.
- Returned Parts and Deposit. Defective displays, batteries, motors, and controllers must be returned, and a refundable deposit of ninety-nine dollars ($99) is required for the replacement. The deposit is refunded upon receipt of the defective part. For Ant Bikes with a frame number beginning with "P," only the Battery must be returned; replacement displays, motors, and controllers are provided for the cost of shipping.
- Labor. Installation or labor costs are not covered unless authorized in advance by Coast & Pedal.
5.2 BRAT. If a defective BRAT Covered Component or battery is determined to be covered, it will be replaced, subject to the following:
- Labor. Labor for replacement is not covered and is the responsibility of the owner.
- Repairs. If a repair is elected instead of replacement, you are responsible for transporting the BRAT to an authorized Volcon dealer or service center in the United States. Labor is covered only for repairs performed by an authorized Volcon dealer or service center. You may have repairs performed at a location of your choice at your own expense.
- Shipping. Standard domestic shipping on replacement BRAT Covered Components or batteries is provided at no charge. Overnight or international shipping is at your expense.
5.3 Exclusive Remedies. The remedies in this Section 5 are your sole and exclusive remedies under this Limited Warranty.
6. Exclusions – What This Limited Warranty Does Not Cover
6.1 All Bikes. This Limited Warranty does not cover damage, defects, or other issues caused in whole or in part by any of the following:
- Normal wear and tear (see Section 7).
- Accident, collision, abuse, neglect, or misuse.
- Stunt riding, ramp jumping, acrobatics, racing, or any activity inconsistent with the intended use of the Bike.
- Improper charging, use of a charger not supplied with the Bike or approved by the manufacturer, or power surges.
- Installation of third-party parts or accessories, or modification of or tampering with any component, including any change to the Bike's speed settings.
- Improper storage or abnormal exposure to water, liquid, chemicals, moisture, abrasives, sand, or dirt.
- External causes, including fire, flood, storm, lightning, earthquake, harsh weather, or theft.
- Assembly, operation, maintenance, service, repair, or adjustment that does not follow the owner's manual, quick start guide, or other instructions provided with the Bike.
- Scratches, dents, and other cosmetic damage not caused by the manufacturer.
- Use for commercial purposes or in connection with a rental operation or program.
6.2 Ant Bikes Only. The following are also excluded:
- Free accessories included with an order.
- Frame corrosion, paint fade, scratches, impact marks, and impact damage.
- Non-reversible frame modification, such as drilling or welding.
- The chain guard mounted to the frame.
- A Battery that has been charged with an inappropriate charger, charged improperly, has broken or tampered seals, or has been used in equipment other than the Ant Bike for which it was specified.
6.3 BRAT Only. The following are also excluded:
- Off-road riding.
- Paint damage or rust.
- Lost or damaged keys.
- Failure to comply with inspection intervals or instructions from Volcon.
7. Wear and Tear
Some components wear based on their function, and the extent of wear depends on care, maintenance, storage, mileage, climate, and road conditions. Bikes left outside or in extreme elements may wear prematurely. You are responsible for regularly inspecting, maintaining, and replacing parts subject to wear ("Wear Items") at your own cost. Wear Items are not covered by this Limited Warranty and include, but are not limited to:
- All Bikes: tires, tubes, spokes, brake pads, disc rotors, drive chain, chainrings, cassettes, and sprockets.
- Ant Bikes: crankset.
- BRAT: rims, brake and gear cables, pinions, bearings, hand grips, foot pedals, seat, and seat covers.
8. Limitation of Liability
8.1 Liability Cap. To the fullest extent permitted by law, Coast & Pedal's liability for breach of this Limited Warranty shall not exceed the actual amount paid by you for the Bike.
8.2 Consequential Damages. In no event shall Coast & Pedal be liable for any consequential, incidental, special, or punitive damages or losses, whether direct or indirect.
8.3 State Law. Some states do not allow the exclusion or limitation of incidental or consequential damages, or limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
9. Dispute Resolution and Governing Law
9.1 Procedure. Our goal is to provide the best possible customer experience. If you believe we have not performed our obligations under the Limited Warranty, the following dispute resolution procedure is available to you.
9.2 Venue and Governing Law. YOU AGREE THAT ALL DISPUTES WITH COAST & PEDAL ARISING OUT OF OR RELATING TO THE LIMITED WARRANTY OR THE SALE, VALUE, CONDITION, OR PERFORMANCE OF THE BIKE MUST BE RESOLVED IN A STATE OR FEDERAL COURT IN WILLIAMSON COUNTY, TEXAS. YOU FURTHER AGREE THAT THE LIMITED WARRANTY AND ALL DISPUTES WITH COAST & PEDAL ARISING OUT OF OR RELATING TO THE LIMITED WARRANTY OR THE SALE, VALUE, CONDITION, OR PERFORMANCE OF THE BIKE SHALL BE GOVERNED AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS, WITHOUT REFERENCE TO ITS CHOICE OF LAW RULES OR PRINCIPLES.
9.3 Mediation. You agree, as a condition precedent to the commencement of any legal action, to participate in a mediation conference with a mutually acceptable mediator in an effort to resolve the dispute. You agree that the mediation conference will take place within fifty (50) miles of Williamson County, Texas, unless the parties agree otherwise.
9.4 Waiver of Right to Participate in Class Actions. YOU AGREE THAT ALL DISPUTES WITH COAST & PEDAL ARISING OUT OF OR RELATING TO THE LIMITED WARRANTY OR THE SALE, VALUE, CONDITION, OR PERFORMANCE OF THE BIKE WILL NOT BE COMBINED OR CONSOLIDATED WITH A DISPUTE INVOLVING ANY OTHER PERSON'S OR ENTITY'S PRODUCT OR CLAIM, AND SPECIFICALLY, WITHOUT LIMITATION OF THE FOREGOING, MUST NOT UNDER ANY CIRCUMSTANCES PROCEED AS PART OF A CLASS ACTION OR COLLECTIVE ACTION. YOU EXPRESSLY WAIVE THE RIGHT TO ACT AS A PRIVATE ATTORNEY GENERAL OR CLASS REPRESENTATIVE OR TO PARTICIPATE IN A CLASS ACTION AS A CLASS MEMBER IN ANY DISPUTE WITH COAST & PEDAL INVOLVING THE LIMITED WARRANTY OR THE SALE, VALUE, CONDITION, OR PERFORMANCE OF THE BIKE.
